{"id":1438,"date":"2016-06-28T15:11:14","date_gmt":"2016-06-28T08:11:14","guid":{"rendered":"https:\/\/sblaw.lawyer24h.net\/?p=1438"},"modified":"2016-06-28T15:11:14","modified_gmt":"2016-06-28T08:11:14","slug":"what-are-the-objects-of-technology-transfer","status":"publish","type":"post","link":"https:\/\/ipvc.com.vn\/en\/index.php\/2016\/06\/28\/what-are-the-objects-of-technology-transfer\/","title":{"rendered":"What are the objects of technology transfer?"},"content":{"rendered":"<p style=\"text-align: justify;\"><em>Technologies the transfer of which is encouraged<\/em><\/p>\n<div style=\"text-align: justify;\">A\u00a0technology\u00a0the\u00a0transfer\u00a0of\u00a0which\u00a0is\u00a0encouraged\u00a0means\u00a0high\u00a0technology\u00a0or\u00a0progressivetechnology\u00a0which satisfies one of the following requirements:<\/div>\n<ul style=\"text-align: justify;\">\n<li>It creates new products which\u00a0are highly\u00a0competitive.<\/li>\n<li>It creates a\u00a0new industry\u00a0or new\u00a0services<\/li>\n<li>It saves energy or raw materials.<\/li>\n<li>It uses new\u00a0energy resources or\u00a0recycled energy.<\/li>\n<li>It protects the\u00a0health of humans.<\/li>\n<li>It prevents or\u00a0fights natural\u00a0disasters\u00a0or\u00a0epidemics.<\/li>\n<li>It results in\u00a0clean production or is environmentally friendly.<\/li>\n<li>It develops traditional\u00a0crafts and industries.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><em>Technologies the transfer of which is restricted<\/em><\/p>\n<ul style=\"text-align: justify;\">\n<li>Transfer shall\u00a0be restricted in the case of\u00a0a technology\u00a0aimed at any one of the following objectives:<\/li>\n<li>Protection of the national\u00a0interest.<\/li>\n<li>Protection of the health of humans.<\/li>\n<li>Protection of national\u00a0cultural values.<\/li>\n<li>Protection of animals and\u00a0plants,\u00a0natural resources or the environment.<\/li>\n<li>Implementation\u00a0of\u00a0a\u00a0provision\u00a0in an\u00a0international\u00a0treaty\u00a0of\u00a0which\u00a0the\u00a0Socialist\u00a0Republic\u00a0ofVietnam\u00a0is\u00a0a member.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><em>Technologies the transfer of which is prohibited:<\/em><\/p>\n<ul style=\"text-align: justify;\">\n<li>A\u00a0technology\u00a0which\u00a0fails\u00a0to\u00a0satisfy\u00a0the\u00a0requirements\u00a0stipulated\u00a0by\u00a0the\u00a0laws\u00a0onoccupational\u00a0safety, labour hygiene, protection of human health, and protection of natural resources\u00a0and the environment.<\/li>\n<li>A\u00a0technology\u00a0which\u00a0creates\u00a0products\u00a0causing\u00a0harm\u00a0to\u00a0socio-economic\u00a0development\u00a0andhaving\u00a0an adverse impact on national\u00a0defence and\u00a0security or\u00a0social order and\u00a0safety.<\/li>\n<li>A technology not\u00a0permitted to\u00a0be transferred\u00a0pursuant to a provision in\u00a0an international treatyof which the Socialist Republic of Vietnam is a member.<\/li>\n<li>A technology on the list of State secrets,\u00a0unless a provision of law\u00a0provides otherwise.<strong><em>\u00a0<\/em><\/strong><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Technologies the transfer of which is encouraged A\u00a0technology\u00a0the\u00a0transfer\u00a0of\u00a0which\u00a0is\u00a0encouraged\u00a0means\u00a0high\u00a0technology\u00a0or\u00a0progressivetechnology\u00a0which satisfies one of the following requirements: It creates new products which\u00a0are highly\u00a0competitive.
