According to Clause 13, Article 4<\/strong>, Law on Intellectual Property of Vietnam<\/p>\n

\u201cPatent<\/strong><\/em>\u00a0is a technical solution, in form of a product or a process, to resolve a specific problem by utilizing laws of nature<\/em><\/strong>.\u201d<\/p>\n

Protection criteria of a patent?<\/strong><\/p>\n

Under Article 58<\/strong>, Law on Intellectual Property of Vietnam, a patent shall be eligible for protection by granting of an Invention Patent<\/strong> if it meets the following conditions:<\/p>\n

(1) Being novel<\/em><\/strong><\/p>\n

(2) Being an inventive nature<\/em><\/strong><\/p>\n

(3) Being susceptible of industrial application.<\/em><\/strong><\/p>\n

The requirement of being novel and being of an inventive step shall be met in global scale<\/p>\n

but not only in Vietnam. \u00a0If\u00a0 the patent meets all requirements, it shall be granted for<\/p>\n

Protection Title which has effect throughout territory of\u00a0 Vietnam.<\/p>\n

Unless the patent is common knowledge, it shall be protected in the form of the grant of a Utility solution Patent<\/strong> when it satisfies the following conditions:<\/p>\n

\u00a0(1) Being novel<\/em><\/strong><\/p>\n

\u00a0(2) Being susceptible of industrial application<\/em><\/strong><\/p>\n

 <\/p>\n

Subject matters not protected as a patents<\/strong><\/p>\n

According to Article 59<\/strong>, Law on Intellectual Property of Vietnam, the following subject matters shall not be protected as patents:<\/p>\n

(1) Discoveries, scientific theories, mathematical methods<\/p>\n

(2) Schemes, plans, rules or methods for performing mental acts, training domestic animals, playing games, doing business, computer programs<\/p>\n

(3) Presentations of information<\/p>\n

(4) Solutions of aesthetic characteristics only<\/p>\n

(5) Plant varieties, animal varieties<\/p>\n

(6) Processes of essentially biological nature for the production of plants and animals other than microbiological processes<\/p>\n

(7) Disease prevention, diagnostic and treatment methods for human or animals<\/p>\n
